About Divorce Mediation

Mediation allows couples to maintain control over the decisions that come with the divorce process.  The participants leave the mediation with a better relationship and a clearer understanding of each others needs.  It enables the parties to create a resolution without a judges involvement.  Typically, mediated settlements are honored by both husband and wife as each had a hand in creating the final outcome.  Once an agreement has been reached, both parties will sign and the agreement will be filed with the court.  This will be a legal binding document and is fully enforceable.

What Does A Divorce Mediator Do?

A divorce mediator is a neutral party that is trained to help divorcing couples resolve the legal and personal issues so both parties can move on with their lives.  Essentially, the mediator is there to open the lines of communication and facilitate a mutual agreement.  Each party will have time to openly speak, opinions and feelings are respected, and each issue will be addressed.

What If We Don’t Reach Agreement On All Issues?
An agreement can be prepared on all settled issues.  The parties can either take some time to think about possible resolutions of the remianing issues and then come back to mediation or proceed to litigation.

Do I Need to Hire An Attorney?

The hiring of an attorney is a personal decision.  Depending on your circumstances, you may wish to have an attorney represent you in the mediation and assist in drawing up the agreement.  If there are numerous assets, children involved, or if there is an imbalance of power between husband and wife, an attorney may facilitate a successful resolution of the issues.

How much does mediation cost?
